- All offers made by the photographer are non-binding. It is not permitted to resell images or transfer usage rights to third parties without written consent. For usage by magazines, newspapers, event organizers, hotels, etc., prior written approval from the photographer is required. The photographer must always be credited as follows: “Photo: © Jutta Christl”. Upon full payment of the agreed fee, the client receives non-exclusive, unlimited private usage rights for the edited photos.
- Commercial usage rights are granted upon payment of the listed surcharge and include use on the client’s own website, social media accounts, and promotional materials. The ownership of the image files remains with the photographer. Delivery of digital image files requires a separate written agreement and – unless otherwise specified – covers only a selected set of images, not all photographs taken.
- Usage rights are only granted once full payment of the agreed fee has been received and only if the photographer is properly credited by name.
- All copyrights and related rights remain with the photographer. Usage permissions (reproduction, distribution, etc.) are only granted through explicit written agreement. The client acquires a simple (non-exclusive, non-transferable) right to use the images for the purpose and within the scope agreed (e.g. publication, geographic and temporal limits). Unless otherwise stated, the usage rights apply only to the client’s explicitly named media and do not include advertising use.
- The client is responsible for obtaining any third-party usage rights and consents, including for the depiction of individuals. The photographer is not liable for any related claims. The photographer guarantees third-party consents only if expressly agreed to in writing for the intended use.
- Unless agreed otherwise, a deposit of 50% of the expected total fee is due upon booking. The remaining balance is due upon completion of the work or upon invoicing, payable immediately.
- The photographer will carry out the assignment with due care and may assign third parties to carry out the work in whole or in part. In the absence of specific written instructions, the photographer has full artistic freedom in executing the assignment, including image composition, model and location selection, and choice of equipment. Variations from previous work do not constitute a defect.
- Unless otherwise agreed in writing, the photographer is entitled to use the created images for self-promotion. The client grants explicit and irrevocable consent for promotional use and waives any claims, particularly under § 78 UrhG (Austrian Copyright Law) and § 1041 ABGB (Austrian Civil Code).
- This promotional usage includes the right to publish the photos on the photographer’s website, social media, and printed portfolio.
- In compliance with data protection laws, the client consents to the processing and publication of their personal data, especially photographs, for the photographer’s promotional purposes.
- Place of performance and jurisdiction is the photographer’s place of business. Austrian substantive law shall apply.
